The creation of the UK Supreme Court

For centuries, the United Kingdom’s highest court of appeal was the Appellate Committee of the House of Lords. This meant that the country’s most senior judges – the Law Lords – sat as members of the legislature. They could, and occasionally did, participate in parliamentary debates and vote on legislation, while simultaneously serving as the final arbiters of legal disputes.

This arrangement was a peculiarly British anomaly. It blurred the constitutional boundary between the judiciary and the legislature – two arms of the state that, in most modern democracies, are kept firmly separate. While the Law Lords were widely respected and the system functioned reasonably well in practice, it created several fundamental problems:

  • Lack of separation of powers – The same individuals could make the law and interpret it, undermining a core principle of constitutional governance.
  • Perception of independence – Even if the Law Lords acted impartially, their membership of a political chamber raised legitimate questions about judicial independence.
  • Transparency and accessibility – Cases were heard in a committee room within the Palace of Westminster, with limited public visibility. There was no dedicated, purpose-built court building open to the public.
  • Compliance with the European Convention on Human Rights – Article 6 ECHR guarantees the right to a fair hearing before an independent and impartial tribunal. The dual role of the Law Lords made this increasingly difficult to defend, particularly after the Human Rights Act 1998 incorporated the Convention into domestic law.

The catalyst: the Constitutional Reform Act 2005

The early 2000s saw growing momentum for reform. In June 2003, the government announced plans to abolish the office of Lord Chancellor in its existing form and create a new Supreme Court. This led to the Constitutional Reform Act 2005, which introduced three major changes:

  1. Creation of the UK Supreme Court – A new, independent institution to serve as the final court of appeal, entirely separate from Parliament.
  2. Reform of the Lord Chancellor’s role – The Lord Chancellor had historically been a judge, a cabinet minister, and the Speaker of the House of Lords simultaneously. The Act stripped away the judicial functions and transferred the role of Speaker to a newly created Lord Speaker.
  3. Establishment of the Judicial Appointments Commission – To ensure judges were selected on merit through an independent, transparent process rather than by political appointment.

The opening: 1 October 2009

The Supreme Court officially opened on 1 October 2009, taking up residence in the Middlesex Guildhall on Parliament Square – directly opposite the Houses of Parliament, yet constitutionally separate from them. The existing twelve Law Lords became the first Justices of the Supreme Court, with Lord Phillips of Worth Matravers serving as the inaugural President.

The new court brought with it:

  • Its own independent administration — No longer part of the parliamentary estate.
  • Televised proceedings — A significant step forward in open justice and public accessibility.
  • A clear constitutional identity — For the first time, the UK’s highest court was visibly and structurally independent from both Parliament and Government.

Why it matters

The creation of the Supreme Court was not about fixing something that was broken in practice – the Law Lords had an excellent reputation. It was about ensuring that the UK’s constitutional arrangements reflected the principles they were supposed to embody. A modern democracy should not merely have an independent judiciary – it should be seen to have one.

The separation also clarified accountability. Parliament makes the law. The Government implements it. The courts interpret and apply it. By housing these functions in distinct institutions, the 2005 Act brought the UK closer to the constitutional clarity that underpins public confidence in the rule of law.
